The following pesticide information is provided
by the Pesticide Notification Network, a system operated by Washington State
University's
Pesticide Information
Center, for the Washington State Commission on Pesticide
Registration.
WSDA's Endangered Species Program is soliciting input
regarding recent court action pertaining to
the
Washington Toxics Coalition Endangered
Species Act lawsuit. WSDA has requested that the message
contained in the attachment portion of
this notification be distributed on the PNN.
The information contained in this notification
is not to be used as a substitute for obtaining and reading pesticide labels.
Information
provided by the PNN is
neither a recommendation nor an endorsement by either Washington State
University or the Washington State
Commission on Pesticide
Registration.

To
whom it may concern
WSDA has the opportunity to provide EPA
with arguments regarding the WTC interim measures. See,
http://agr.wa.gov/PestFert/EnvResources/Lawsuit.htm for more
information. WSDA would like to supply
information in two areas:
1. Buffer Size (Unfortunately, the
courts ruling is very specific in regards to arguments that can be made. For all
intensive purposes arguments can only be made
regarding the width of
buffers.)
2. Issues of clarification
regarding the final ruling. (e.g., Does this ruling apply to products for which
an NPDES permit has been issued?)
If you have information that can be used
to mitigate buffer widths or issues for clarification please provide written
comments to WSDA by August 1, 2003.
